Nerida sailing school organises sporting sailing courses designed to teach sailing skills at sea and to discover the local marine and terrestrial environment. Each course is supervised by a professional instructor skipper responsible for safety and the organisation of navigation. Sailing with Nerida implies adhering to the following values:

Safety The safety of the crew and vessel is the absolute priority. The skipper is the sole decision-maker regarding safety, manoeuvres, route and course of the programme. Each participant undertakes to listen to, understand and follow instructions without reservation, and to wear mandatory safety equipment when required.

Seafaring spirit Nerida fosters a spirit of solidarity, respect and humility within the crew, and towards local communities and other sailors. Each participant undertakes to adopt considerate communication and behaviour, contribute to the atmosphere on board and take part in collective life. No form of discrimination will be tolerated.

Respect for the environment Nerida is deeply committed to environmental preservation, both at sea and ashore. Each participant undertakes to respect local fauna, flora and navigation zones, minimise their environmental impact and adopt a responsible and sustainable attitude.

This contract sets out the conditions for participation in a 10-day sporting sailing course organised by Nerida sailing school, including: - pedagogical supervision by a professional instructor skipper - learning and practice of sailing - participation in navigation, manoeuvres and life on board - discovery of various islands of the archipelago

Nerida courses are sailing courses, involving active participation in collective life on board and continuous adaptation to sea and weather conditions.

The participant acknowledges that sailing takes place in a potentially demanding natural environment and that certain situations (weather, rough seas, manoeuvres) may require physical effort and particular vigilance. The participant acknowledges being informed of the risks inherent in sailing and participates voluntarily in the activity.

To participate in the course, the participant declares being in good physical condition, able to swim at least 50 metres, and having no medical contraindication to sailing.

The organiser may request a medical certificate of fitness.

The participant arranges their own transport to the boarding location.

In the event of delay or absence, the organiser reserves the right to begin the course without them and no refund may be claimed. The organiser cannot be held responsible for transport delays or cancellations, or for external events that may disrupt arrival at the boarding port.

In accordance with maritime navigation rules, the skipper is master of the vessel and as such is the sole decision-maker regarding safety, navigation and course organisation. They may modify the itinerary, programme, stopovers, activities and interrupt the route at any time in the interest and safety of the crew and vessel, as navigation depends directly on weather conditions, sea state, and maritime safety constraints. Such adaptations do not constitute a breach of contract and do not give rise to any refund or compensation.

Applicable prices are those displayed on the website at the time of booking, expressed in euros. For bookings benefiting from a specific pricing offer, the booking confirmation email will specify the public price, the discount granted and the applicable contractual price.

Unless otherwise stated, the price includes: - supervision by a professional instructor skipper - theoretical and practical sailing instruction - use of the boat and its equipment

Not included in the stated price: - the on-board kitty of €300 for expenses related to the operation of the boat (provisioning, ports, fuel, linen) which remain the participant's responsibility - transport to the boarding location - personal expenses - individual insurance - any costs related to medical evacuations or exceptional expenditure.

A course booking is confirmed upon signing of this contract and payment of a deposit equal to 50% of the course price. The remaining 50% balance must be paid no later than at boarding on the first day of the course. Failing payment within the stipulated timeframe, the organiser may cancel the booking and retain the deposit paid as compensation.

Payment is made by bank transfer to the account indicated by Nerida upon booking confirmation.

Payment by credit card is possible at the participant's express request.

In the event of cancellation by the participant within 30 days before the departure date, no refund will be made, regardless of the reason for cancellation. However, the organiser may offer to reschedule the course in cases of force majeure making it impossible for the participant to attend, subject to availability on subsequent courses, 15 days before departure. This option to reschedule remains at the sole discretion of the organiser.

The organiser may cancel a course for reasons of safety, technical issues, insufficient number of participants or force majeure (exceptional weather conditions, natural disaster, pandemic, administrative restrictions, armed conflict). In such cases, rescheduling the course will be offered as a priority. If rescheduling is not possible, all amounts paid will be fully refunded. No further compensation may be claimed.

The participant is informed that any damage to the boat or equipment resulting from use not intended for that purpose, or following deliberate or repeated non-compliance with the skipper's instructions, may be charged to them. The participant assumes personal liability for any physical, material or immaterial damage caused to themselves, others or the equipment. In the event of non-compliance with instructions, the participant expressly releases the organiser from all liability for any resulting consequences.

This release does not apply in cases of serious or intentional misconduct by the organiser, in accordance with the law.

The boat is insured in accordance with maritime regulations.

Each participant must hold personal civil liability insurance. It is recommended to take out travel and repatriation insurance. The organiser cannot be held responsible for the participant's lack of insurance.

In the event of a medical situation requiring evacuation or assistance, the skipper may take any decision deemed necessary for the participant's safety. Medical or evacuation costs remain the responsibility of the participant and their insurance.

Each participant remains responsible for their personal belongings. The organiser accepts no liability in the event of loss, theft or damage.

The organiser may decide to immediately exclude a participant in the event of: - non-compliance with safety instructions - a health condition or behaviour that is dangerous or incompatible with life on board - excessive consumption of alcohol or illicit substances - endangering the vessel or crew

Such exclusion gives rise to no refund and no right to compensation.

Unless the participant objects in writing, the organiser may use photographs or videos taken during the course for communication or promotion purposes for the sailing school.

This contract is governed by French law. Any dispute relating to its interpretation or performance shall be submitted to the exclusive jurisdiction of the courts of Toulouse.

Where a booking is made on behalf of several people or in the context of a private charter, the person signing this contract acts as group representative and contact. The representative undertakes to communicate this contract in full to all participants before the start of the course, and guarantees by their signature alone that each participant accepts its provisions, participation conditions, course arrangements and safety rules on board. These conditions apply to all persons on board.

The representative remains the organiser's sole contractual contact, particularly regarding booking, payment and course organisation arrangements.

By confirming their booking, the participant acknowledges having read these general terms and conditions of sale (T&Cs), understands their scope and accepts all provisions without reservation. Submitting a booking request via the website www.neridasails.com constitutes electronic acceptance of these T&Cs.
